Please read these Terms of Use ("Terms") carefully before using Nosh (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. Acceptance of Terms
By creating an account or using Nosh, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and that you agree to comply with these Terms. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Description of Service
Nosh is a calorie tracking application that allows you to log food intake using natural language text input. The App uses artificial intelligence to estimate calorie and macronutrient values based on your descriptions. Nosh is designed for general wellness purposes and is not a medical device, nutritional counseling tool, or substitute for professional dietary advice.
3. Account Registration
You may create an account using Sign in with Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account.
4. AI-Powered Calorie Estimates
Nosh uses AI (powered by third-party language models) to generate calorie and macronutrient estimates from your food descriptions. You acknowledge and agree that:
AI estimates are approximations and may not be accurate for every food item, portion size, or preparation method.
You have the ability to review and adjust any estimate before it is saved to your log.
Nosh does not guarantee the accuracy, completeness, or reliability of any AI-generated estimate.
You should not rely solely on Nosh for medical, dietary, or nutritional decisions.
5. Acceptable Use
You agree not to use the App to:
Violate any applicable law or regulation.
Attempt to reverse-engineer, decompile, or disassemble any part of the App.
Interfere with or disrupt the App's servers, networks, or infrastructure.
Submit false, misleading, or harmful content through the App's input fields.
Use the App in any manner that could abuse, overload, or exploit the AI estimation service.
6. Subscriptions and Payment
Nosh may offer free and premium subscription tiers. If you purchase a premium subscription:
Payment will be charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
You can manage and cancel subscriptions through your Apple ID settings.
Refunds are subject to Apple's refund policies.
7. Intellectual Property
All content, features, functionality, design elements, and trademarks in the App are owned by the developer of Nosh and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
8. User Data and Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in the Privacy Policy. Your food log entries and account data are stored on secure cloud servers. You retain ownership of your personal data and may request its deletion at any time by contacting us.
9. Health Disclaimer
Nosh is intended for general informational and wellness tracking purposes only. The App is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before making significant changes to your diet, especially if you have a medical condition, food allergies, or an eating disorder. We do not assume liability for any health outcomes related to your use of the App.
10. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
11. Limitation of Liability
To the maximum extent permitted by applicable law, the developer of Nosh shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising out of or related to your use of the App, regardless of the theory of liability. Our total aggregate liability for any claims arising from your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless the developer of Nosh from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after such changes constitutes acceptance of the updated Terms.
14. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will continue to apply.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in King County, Washington.
